SEC Regulators Examine Crypto, Companies Like Ethereum (ETH), Ripple (XRP), and TMS Network (TMSN) Adjust Accordingly

The Securities and Exchange Commission (SEC) of the United States has added the regulation of new technologies and crypto assets to its agenda. The SEC is planning to scrutinize whether companies dealing with cryptocurrencies, such as Ethereum (ETH) and Ripple (XRP), are qualified to provide investment advice. The SEC changes its mind about Ethereum (ETH) – Again!

One might be forgiven for thinking that the SEC has it in for Ethereum (ETH). In October 2018, the SEC stated categorically that Ethereum (ETH) is not a security and thus not under SEC jurisdiction. Four years later, in October 2022, the SEC stated that Ethereum (ETH) actually is a security. 

The SEC can’t seem to decide its own stance. But hedging its bets, the SEC has added a new clause to its mandate in an attempt to regulate the cryptosphere: due diligence when dispensing investment advice.  

Whether the Ethereum foundation – the governing body of Ethereum (ETH) - actually actively dispenses investing advice is up for debate. But what isn’t, is that the Ethereum Foundation is domiciled in Switzerland, and thus outside the scope of the SEC’s agenda. Undoubtedly this will not deter the SEC, but in the meantime, coin holders in the USA may see their capacity to engage with Ethereum (ETH) based DeFi (such as staking) curtailed. 

However, this has not hurt the Ethereum (ETH) price. The Ethereum (ETH) price gained $100 since the first week of February 2023, effectively dismissing SEC concerns.  

Ripple (XRP) And The Story Of The Never-Ending Legal Battle.

The SEC filed a lawsuit against Ripple Labs, Inc. on December 22, 2020, alleging that the company had conducted a $1.3 billion unregistered securities offering by selling Ripple (XRP) tokens. Since then, the legal case has been ongoing, and there has been much debate about whether Ripple (XRP) should be considered a security or not.

The SEC–Ripple (XRP) court case has been a constant theme in the cryptoverse, with many investors and traders keeping a close watch on the outcome. This has, at various times, both dampened and bolstered the Ripple (XRP) price, but market sentiment is bullish.  

Seemingly, investors are as fed up with the SEC’s contradictory opinions and the protracted legal battle, and Ripple (XRP) has seen a resurgence. However, the SEC is not likely to give up easily, and the Ripple (XRP) court case is still ongoing. Whatever the outcome, Ripple (XRP) is here to stay and still sits at number six by market cap among cryptos.
